Minnesota joins Michigan as the second state in the region to adopt its own rules in addition to federal guidelines.&lt;br /&gt;&lt;br /&gt;The new rules affect ships operating within the lakes, also known as “lakers,” and ships from the ocean, or “salties.”  Ships built in 2012 and after must treat their ballast water before discharging, and all other ships must do so by 2016.  Treatment systems must meet International Maritime Organization (IMO) Performance Standards. Get the article &lt;a href="http://www.socgenmicrobiol.org.uk/pubs/micro_today/pdf/050805.pdf"&gt;here.&lt;/a&gt;&lt;br /&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;When water is pumped out of ballast tanks, it can release disease-causing microbes, said Fred Dobbs, a marine microbial ecologist at Old Dominion University in Virginia.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;"This is a very difficult thing to predict," Mr. Dobbs said Wednesday in a telephone interview.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;"It isn’t an issue, of course, until the ship discharges its ballast water, and anything that’s lived throughout the course of the voyage will subsequently be dumped into receiving waters."&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;He was able to track Vibrio cholerae, the bacterium that causes cholera in humans, from an outbreak in Peru to Mobile, Ala. &lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;"We had a pretty good smoking gun argument that ships were transporting these disease organisms from South to North America," said Mr. Dobbs, whose article, titled Ship ballast tanks: how microbes travel the world, appears in the recent edition of Microbiology Today.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;Untreated cholera can be deadly.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;"The deaths are occurring on the Indian subcontinent, principally, and in South America. There are various estimates between 10,000 and 50,000 people per year that die from the disease."&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;Other disease-causing microbes in ship ballast tanks, which Mr. Dobbs said are sampled very rarely, include Cryptosporidium parvum and Giardia duodenalis. Both can cause stomach upset. Researchers also found enterovirus in ballast water, which can cause mild respiratory illness and hand, foot and mouth disease.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;"We’re playing ecological roulette . . . with transporting all these species everywhere all the time," Mr. Dobbs said.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;He stressed there’s been no documented case of disease outbreaks associated with the ballasting activities of ships. &lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;"In particular, in the U.S. and Canada, we’ve got a couple of things working in our favour. No. 1, the water is cool to cold, depending on how far up the coast you are. And we also have very good hygiene. People aren’t washing their clothes and taking drinking water from the same rivers in which there’s sewage pollution."&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;But ballast water could carry diseases deadly to fish and seabirds, he said.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;"Red tide organisms can be transported by ships as well," said Mr. Dobbs, noting agents that cause paralytic shellfish poisoning can also stow away inside ballast tanks.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;"That may be as much, if not more, of an issue for us to be considering. The upshot of this is, whether it’s at the U.S., state, Canadian, national or even the international arena, there are a series of standards that are either being proposed or, in fact, are already in force."&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;Those regulations stipulate what organisms can be discharged with ballast water.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt; "These are daunting technological and scientific challenges that, arguably, have been made, in some cases, by politicians who don’t appreciate the technical difficulties involved," Mr. Dobbs said.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;Ultraviolet radiation and chlorine can be used to treat ballast water, he said. Ultrasound, heat, microwaves and hydrogen peroxide are also proposed fixes.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;"There is filtration, which does a great job, but it can only get down to maybe about 25 micrometres, and your garden variety bacterium is one micrometre or less. So filtration isn’t going to get out bacteria."&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;Ships pump water into and out of ballast tanks to compensate for cargo, increase propulsion efficiency and maximize stability in rough seas.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;Mariners are supposed to discharge their ballast water far out to sea, he said. But that can cost time and fuel, an outlay unscrupulous captains might be anxious to avoid. Skippers can also claim an exemption if seas are rough.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span class="Content_body-links"&gt;"Some shipping companies are very, very good, and others, it’s hard to know whether they’re good or not. The first, a manager's  amendment, improves transparency by requiring that regulated ships submit  records of their actions to the Secretary of Transportation on a monthly basis,  and ensures that ships claiming &lt;/span&gt;no ballast on board (NOBOBs) will be  required to conduct saltwater flushing. &lt;span style="color: black;"&gt;A second  amendment by Representative Mark Kirk (R-IL) gives the Coast Guard the authority  to take emergency response measures if vessels operating exclusively within the  &lt;st1:place st="on"&gt;Great Lakes&lt;/st1:place&gt; present the risk of spreading  invasive species or infectious diseases.&lt;span style=""&gt;   &lt;/span&gt;&lt;/span&gt;H.R. 2830 also requires that in 2009 shippers must begin  installing ballast water treatment systems that meet an interim standard in  vessels that enter &lt;st1:country-region st="on"&gt;&lt;st1:place st="on"&gt;U.S.&lt;/st1:place&gt;&lt;/st1:country-region&gt; waters.  All ships will be  required to have ballast technology on board by 2014. Although invasive species are widely recognized as a major threat to marine biodiversity, there has been no quantitative global assessment of their impacts and routes of introduction. The report gives initial results from the first such global assessment. Drawing from over 350 databases and other sources, it synthesizes information on 329 marine invasive species, including their distribution, impacts on biodiversity, and introduction pathways. Initial analyses show that only 16% of marine ecoregions have no reported marine invasions, and even that figure may be inflated due to under-reporting. International shipping, followed by aquaculture, represent the major means of introduction. Beginning with the 2008 navigation season, all ocean vessels, including those with "no ballast on board," will be subjected to an inspection, covering 100 percent of ballast water tanks. This inspection process will ensure that the vessel--while still a minimum of 200 km offshore--flushed all of its tanks with salt water.&lt;br /&gt;&lt;br /&gt;Since 2006, all ocean vessels bound for a Canadian port have been subjected to ballast water inspections, to ensure that water within the ballast tanks adheres to a minimum level of salinity of 30 parts per thousand. The car carrier Georgia Highway was equipped with features such as a triple hull to prevent oil spills, as well as cement ballast and silicone paint, both used to reduce the possibility of introducing invasive species to a port. The carrier is one of three of its size with such features operated by Japanese shipping company Kawasaki Kisen Kaisha Ltd., or K-Line. The company also has three smaller ships built with environmentally friendly features, including main engines that are electronically controlled to cut emissions.&lt;br /&gt;&lt;br /&gt;The permanent cement ballast reduces the amount of water ballast the ship takes on to give it the proper weight balance. Capt. Yoshizawa said &lt;span style="font-style: italic;"&gt;Georgia Highway&lt;/span&gt; also has a new type of paint on its hull that keeps organisms in the port, such as kelp or algae, from clinging to the ship. That means less drag on the ship, but it also reduces the possibility that the ship will transport something from one port to another.&lt;br /&gt;&lt;br /&gt;The ships aren't the only ones adding green features. FitzPatrick Nuclear Power Plant three times in the past two months, scientists said. The FitzPatrick plant, on the lakeshore in Scriba, was shut down Sept. 12, Oct. 14 and Oct. 28 when seaweed clogged filters, reducing the amount of water available to cool the reactor. The shutdown costs the plant between $1.5 million and $2 million a day in lost revenue, according to federal figures.&lt;o:p&gt;&lt;/o:p&gt;&lt;/p&gt;          &lt;p class="MsoNormal"&gt;The seaweed, called Cladophora, is a "filamentous algae," that grows in fine strands and isn’t edible by the zebra and Quagga mussels that have so successfully made &lt;st1:place st="on"&gt;&lt;st1:placetype st="on"&gt;Lake&lt;/st1:placetype&gt;  &lt;st1:placename st="on"&gt;Ontario&lt;/st1:placename&gt;&lt;/st1:place&gt; home. The mussels eat all sorts of free-floating algae - that's how they've managed to make &lt;st1:place st="on"&gt;Lake &lt;/st1:place&gt;&lt;st1:state st="on"&gt;Ontario&lt;/st1:state&gt;, &lt;st1:placename st="on"&gt;Onondaga&lt;/st1:placename&gt; &lt;st1:placetype st="on"&gt;Lake&lt;/st1:placetype&gt; and other bodies of water in &lt;st1:place st="on"&gt;Central New York&lt;/st1:place&gt; so much clearer. &lt;st1:place st="on"&gt;Lake&lt;/st1:place&gt; waters cleared of algae by the mussels allow more sunshine to penetrate deeper, encouraging Cladophora to spread to more of the lake bottom. Then, as winds blows, choppy waters scrub Cladophora from the lake bottom. The fine strands piled up so densely, he said, water couldn't pass through. In two of the three incidents, operators had to scram the plant - that is, drive control rods into the reactor to snuff the nuclear reaction as quickly as possible. The federal Department of Fisheries and Oceans Canada is conducting assessments of the risks posed by these two crab species in Canadian waters.  Part of the invasive species risk assessment process that has been adopted by DFO's Centre of Expertise in Aquatic Risk Assessment is an expert opinion survey to identify important vectors and impacts of the species, worldwide. The data obtained from the ballast water reporting forms submitted by the qualifying vessels will enable the State to make better assessments of the potential risk that an incoming vessel might contain alien species in its ballast water holds. This program covering the St. Lawrence and Great Lakes corridor is the first of its kind in North America. Program participants already include over 25 leaders representing the bulk of marine operations in this corridor. Hull maintenance and cleaning of commercial vessels is necessary to remove the attached invasive species.  AB 740 would reduce the introduction of invasive species into California’s coastal waters through increased regulation of large commercial vessels entering California ports.  Specifically, the bill would expand the current ballast water regulatory program to include cleaning and maintenance of the vessel hulls. The film was produced by the International Maritime Organization (IMO), the United Nations agency responsible for the safety and security of shipping and the prevention of marine pollution by ships, in cooperation with the BBC and the shipping industry.    &lt;p class="MsoNormal"&gt;&lt;i style=""&gt;Invaders from the Sea&lt;/i&gt; shows how harmful organisms transported in ballast water by ships have devastated biological and economic resources in many areas around the world, largely due to expanded maritime trade and traffic volume over the last few decades. The film captures the dramatic impact of this issue on the lives of millions of people, using examples of three harmful organisms, which have been transported to new areas in ships’ ballast water: the North American comb jelly, the Golden mussel (&lt;i style=""&gt;Limnoperma fortunei&lt;/i&gt;) and toxic algae (aka red tides and harmful algal blooms). &lt;/p&gt;    &lt;p class="MsoNormal"&gt;The film also highlights the progress made by IMO and the maritime industry in addressing this issue and the measures that can be taken to prevent the spread of harmful organisms. Regularly visiting vessels that attain this status may receive dispensation from inspection. A trial starts on 15 October with three shipping agents and the ships they handle. The standard will become operational in full for most vessels on April 7, 2008 and for cruise passenger vessels and pleasure craft at the start of the 2008/09 season. During markup of the Ballast Water Management Act of 2007 (&lt;/span&gt;&lt;a title="http://thomas.loc.gov/cgi-bin/query/z?c110:S.1578:" href="http://thomas.loc.gov/cgi-bin/query/z?c110:S.1578:"&gt;&lt;span title="http://thomas.loc.gov/cgi-bin/query/z?c110:S.1578:"   style="font-family:Times New Roman;font-size:100%;"&gt;S. 1578&lt;/span&gt;&lt;/a&gt;&lt;span style="font-family:Times New Roman;font-size:100%;"&gt;), Committee  Chairman Daniel Inouye (D-Hawaii) agreed to continue discussions with Sen.  Barbara Boxer (D-Calif.) to resolve the issue of which federal agency should  have lead authority over ballast water. As it stands now, the bill would direct  the Department of Homeland Security, in consultation with the Environmental  Protection Agency (EPA) and other agencies, to set the standards. Boxer, who  chairs the Senate Environment and Public Works Committee, said she opposes the  bill as written because it would prevent states from imposing tougher ballast  water treatment requirements and preempt the EPA from regulating ballast water  discharges under the Clean Water Act. NOAA's National Center for Research on Aquatic Invasive Species and Smithsonian Environmental Research Center analyzed the delivery of ballast water to the Great Lakes and Chesapeake Bay.   &lt;p&gt; These studies indicate reductions in the risk of invasive species introductions as a result of ballast water exchange. The analysis provides further confidence that overall, there has been a decline in the risk of invasion from ballast water in these regions. In addition, the report addresses a potential gap in the coastal ballast management protection framework where ships traveling less than 200 miles from the U.S. coast are not covered. &lt;/p&gt;      &lt;p&gt;The report suggests that a standardized survey program, targeting key coastal ecosystems in the U.S., could provide the high-quality data necessary to (a) assess current invasion risk and (b) measure the performance of multiple management actions, including those of ships and other transfer mechanisms, in terms of invasion occurrence. Aside from recreational boaters, the new rule will mostly affect Canadian and other foreign freighters calling at the port of Thunder Bay, Ontario.&lt;/p&gt;   &lt;p&gt;The emergency regulation is designed to protect the park's fish populations from a deadly virus spreading rapidly across the other Great Lakes, Phyllis Green, superintendent of Isle Royale. Viral hemorrhagic septicemia, or VHS, is among many exotic species that scientists believe have been scooped into ships' ballast tanks in foreign ports, then discharged into the Great Lakes. VHS has not shown up in Lake Superior, but has caused large die-offs of popular game species such as walleye, northern pike and yellow perch in the other lakes and some inland waterways.&lt;/p&gt;  &lt;p&gt;The rule will affect Canadian and other commercial ships because the shipping lane between Thunder Bay and the Soo Locks, gateway to Lake Superior, runs through Isle Royale waters, Green said. Nearly all those ships are Canadian or based in other foreign countries, said Glen Nekvasil, spokesman for the Lake Carriers Association, which represents U.S.-flagged freighters that remain inside the Great Lakes system.&lt;/p&gt;  &lt;p&gt;Green said lake trout around Isle Royale were especially vulnerable, especially this time of year, when they are congregating to spawn and can spread disease quickly between them. Her order, which takes effect Tuesday, September 18, covers a 684-square-mile (1,772-square- kilometer) area, including 475 square miles (1,230-square-kilometers) of waters within park jurisdiction. a summary of report content is as follows:&lt;br /&gt;&lt;br /&gt;A “Code of Best Practices for Ballast Water Management” was adopted by the Shipping Federation of Canada and the (U.S.) Lake Carrier's Association in 2000. In 2002 the St. Lawrence Seaway corporations adopted rules making compliance with the Code mandatory for entry into the Seaway. The Code promotes the maintenance of relatively clean ballast tanks through a program of regular inspection and cleaning, combined with a precautionary approach to ballasting with the objective of limiting or avoiding the uptake of ballast under specified conditions. However, there has never been an assessment of the extent to which commercially operating ships can realistically apply these practices or the effectiveness of the stated practices for reducing the risk of new species introductions.&lt;br /&gt;&lt;br /&gt;A group of researchers therefore conducted a scientific study to 1) test and evaluate the effectiveness of the current Best Management Practices (BMPs), focusing on a subset that are specifically applicable to ballast management for reduction of invasion risk associated with empty ballast tanks on ships entering the Great Lakes with no pumpable ballast-on-board (NOBOB), and 2) test a set of enhancements to the existing BMPs, focusing on flushing of tanks with deep ocean water, either when the ship is in NOBOB condition or as an intermediate step in deep ocean exchange. In particular, they wanted to examine whether BMPs are effective at reducing the abundance and viability of live organisms and resting stages.&lt;br /&gt;&lt;br /&gt;They concluded that current rules for minimizing AIS entry into the Great Lakes are not adequate; the study recommends that ships be required to rinse their ballast tanks with deep-ocean water before entering the St. Lawrence Seaway. The bill would amend and strengthen existing federal law regulating invasive species from ships - the Non-indigenous Aquatic Nuisance Prevention and Control Act of 1990. &lt;br /&gt;&lt;br /&gt;The bill was removed from the agenda prior to the August recess due to ongoing questions related to whether the bill should preserve the possible application of the Clean Water Act to discharges of invasive species from ships.  In September 2006, the U.S. District Court for the Northern District of California vacated a long-standing EPA regulation that exempted discharges incidental to the normal operation of vessels from NPDES permitting requirement. This ruling, which EPA is appealing, applies to vessel discharges that are currently exempted, such as ballast water, sewage, gray water, and bilge water.  This court ruling could mean that the states would be required to regulate such discharges from all ships operating in U.S. waters, which EPA estimates as 13 million recreational boats, 81,000 commercial fishing vessels, and 53,000 freight and tank barges.&lt;br /&gt;&lt;br /&gt;The Senate bill (S. 1578) intends to uniformly manage ballast water to minimize the discharge of invasive species. Shipping interests have expressed concern that regulating such discharges through the NPDES permit program would be problematic, and that vessel discharges would be subject to numerous and potentially conflicting state and federal regulatory approaches. Some environmental groups and States have opposed the bill because they want ballast water to be regulated under the Clean Water Act. The new Guide is intended to provide an overview of the current status of ballast water treatment technologies. PAUL, Minn. (AP) - The Minnesota Pollution Control Agency has been sued for allegedly failing to take action to protect Lake Superior and other state waters from a deadly fish virus.&lt;br /&gt;The lawsuit filed in Ramsey County District Court seeks to force the state to prohibit Great Lakes freighters from dumping untreated ballast water into Duluth Harbor and other ports. &lt;/p&gt;  &lt;p&gt;The Minnesota Center for Environmental Advocacy claims in the lawsuit that ballast water contains fish wastes, fish reproductive materials and infected fish that can spread the virus - viral hemorrhagic septicemia - which kills fish by severe hemorrhaging. The virus has infected fish in all of the Great Lakes except Lake Superior and has killed large numbers of more than a dozen species, including such popular game fish as walleye, muskellunge, smallmouth bass, northern pike, yellow perch and black crappies. &lt;/p&gt;   &lt;p&gt;  The lawsuit contends that in addition to the Great Lakes, many of Minnesota's interior lakes and waters are also at risk. The MPCA said national regulations rather than separate state laws would be a more effective way to regulate ships' wastes. Commissioner Brad Moore said the agency is "doing essential research and analysis" on state rules in case federal authorities don't act. &lt;/p&gt; &lt;p&gt;"We acknowledge that there has to be a national or international solution eventually since ships are travelling all over," said Kevin Reuther, lawyer for the Minnesota Center for Environmental Advocacy. The committee agreed ships built on or after Jan. 1, 2009, must comply with the Convention when traveling to, or within the jurisdictional waters of, states that have ratified it. &lt;/span&gt;&lt;/p&gt; &lt;p align="left"&gt;&lt;span style=";font-family:Arial,Helvetica,sans-serif;font-size:100%;"  &gt;The extent of retroactivity of the compliance date for ships flying the flag of non-signatory states remains unknown. Several states (including Norway, Japan, and the United States) disagreed with the above view. &lt;/span&gt;&lt;/p&gt; &lt;p align="left"&gt;&lt;span style=";font-family:Arial,Helvetica,sans-serif;font-size:100%;"  &gt;With no agreed position on the extent of retroactivity and without any approved technologies available, the proper course of action for the industry to take is not clear at all. It is important to note that this Convention does not alleviate a yacht from complying with the existing ballast water regulations already in place and heavily enforced in the United States and Brazil. &lt;/span&gt;&lt;/p&gt; &lt;p align="left"&gt;&lt;br /&gt;&lt;span style="font-weight: bold;font-family:Arial,Helvetica,sans-serif;font-size:100%;"  &gt;Antarctic ballast waters exchange&lt;/span&gt;&lt;/p&gt; &lt;p align="left"&gt;&lt;span style=";font-family:Arial,Helvetica,sans-serif;font-size:100%;"  &gt;The Committee adopted guidelines providing common guidance for vessels undertaking ballast water exchange in Antarctic waters. They call for ballast that will be discharged in Antarctic waters to first be exchanged before arrival in Antarctic waters (preferably north of the Antarctic Polar Frontal Zone or 60 degrees S, whichever is the farthest north) and at least 200 nm from the nearest land in water at least 200 m deep. If this is not operationally possible, such exchange should be undertaken in waters at least 50 nm from land in water at least 200 m deep. &lt;/span&gt;&lt;/p&gt; &lt;p align="left"&gt;&lt;span style=";font-family:Arial,Helvetica,sans-serif;font-size:100%;"  &gt;Only tanks discharged in Antarctic waters would need to undergo exchange. Ballast water taken onboard from Antarctic waters that is intended to be discharged in Arctic, sub-Arctic, or sub-Antarctic waters should be exchanged north of the Antarctic Polar Frontal Zone, and at least 200 nm from the nearest land in water at least 200 m deep. The man apparently was not a strong swimmer and got caught in a bed of milfoil -- an invasive weed that grows in many Washington rivers and lakes. Applications are due by August 6, 2007. The estimated start date for work is September 17, 2007.&lt;/p&gt;  &lt;p&gt;The GSI is a collaborative effort to end the problem of ship-mediated invasive species in the GLSLSS through independent research and demonstration of environmental technology, financial incentives and consistent basin-wide harbor monitoring.
